Severance Payments

You have worked for years for your employer, and you have been a dedicated and productive employee. But your employer tells you that it has to let you go. You didn't do anything wrong - it just it does not need you anymore. They say there is a reorganization or that times are hard, and they are having a reduction in force. There is going to be a lay off, and you are going to be included. You notice that they are giving more severance payments to some other employees, that they are being unfair. That may be illegal under the Employee Retirement Income Security Act (ERISA) in New York State and New York City, as your employer may have a written or informal plan that it has to follow when making severance payments.
